The Promotion of Access to Information Act, 2 of 2002 (PAIA) gives effect to the constitutional right of access to any information held by the State and also to any information that is held by another person which is required for the exercise or protection of the rights of the person requesting the information. Section 51 of PAIA requires a private Organisation to provide such information to a requester that can demonstrate that a specific record is required for the exercise or protection of any of his/her legal rights and he/she has complied with the procedural requirements. The record will not be supplied where access is refused on any of the grounds set out in PAIA.
